Terms of Service

The rules of the road — what you can expect from us, and what we ask of you.

1. Agreement

These Terms of Service ("Terms") govern your use of BuildMidas — the website at buildmidas.com, the dashboard, and every agent, builder, and publishing feature offered through them (together, "the Service"). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.

2. What the Service is

BuildMidas is a platform of AI agent teams that research product opportunities, build software (websites, web apps, games, mobile apps, desktop apps, and browser extensions), ship it to the web and to app stores, draft marketing content, and monitor and optimize what you shipped. Agents act on your instructions and on the products in your workspace.

AI systems produce output probabilistically. We work hard on verification — builds run through automated review, security, accessibility, and conformance checks — but we do not guarantee that any given build is error-free, fit for a particular purpose, or will be accepted by any third-party store. You are responsible for reviewing what you publish.

3. Your account

  • You must provide accurate account information and keep your credentials confidential. Actions taken through your account are your responsibility.
  • Accounts are for a single person or organization. Don't share, sell, or transfer an account without our written consent.
  • We may suspend accounts that violate these Terms, abuse the Service, or create risk for other users or third parties.

4. Plans, credits, and billing

  • Paid plans renew monthly until cancelled. Each plan includes a monthly credit allowance that resets at the start of each billing cycle and does not roll over.
  • Separately purchased credit packs never expire and are consumed only after your monthly allowance runs out.
  • Credits are consumed by agent work — builds, research runs, marketing drafts, optimization passes. Rates by action type are shown on the Pricing page.
  • Prices are listed in USD; local-currency figures shown in the interface are estimates. Taxes may apply depending on your location.
  • Refunds are governed by the Refund Policy.

5. Your content and ownership

  • You own what you make. Prompts, knowledge files, and other materials you provide remain yours. The apps, sites, games, and content the agents build in your workspace belong to you, to the extent of our rights in them — including commercial use.
  • You grant us the license we need to operate the Service: hosting, processing, backing up, and displaying your content to you, and — only where you use those features — publishing it to your chosen domains and stores and generating previews.
  • Your published products may include open-source components (engines, frameworks, libraries) that carry their own licenses. Those licenses govern those components.
  • Showcase pages display builds we feature. If you don't want a build featured, tell us via Contact and we'll remove it.

6. Acceptable use

Don't use the Service to build, publish, or promote:

  • anything illegal, or content that infringes others' intellectual-property, privacy, or publicity rights;
  • malware, phishing pages, or software designed to deceive or harm users;
  • spam, coordinated inauthentic promotion, or content that violates the rules of a platform you're posting to;
  • content that exploits or endangers minors, or that promotes violence or hatred against people.

Don't probe, overload, or interfere with the Service, other tenants' data, or the isolation between accounts. We may remove content and terminate accounts for violations.

7. Third-party services and your credentials

  • Optional features connect to third-party services with credentials you supply: Google Search Console and Google Analytics for measurement, app-store developer accounts for shipping, social platforms for posting, and your own servers for deployment.
  • You confirm the credentials you connect are yours (or you're authorized to use them) and that your use of each connected service complies with its own terms.
  • Publishing to app stores is subject to each store's review and policies. We prepare and submit; the store decides. Store developer fees are yours.
  • Third-party services can change or revoke access at any time; features depending on them may be affected.

8. Service changes and availability

We continuously improve the Service and may add, change, or retire features. We aim for high availability but do not guarantee uninterrupted service. Scheduled agents ("autonomous" modes) run on a best-effort schedule.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. AI OUTPUT MAY CONTAIN ERRORS; VERIFY BEFORE RELYING ON IT.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BUILDMIDAS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE.

11. Termination

You may stop using the Service and cancel your plan at any time in Settings. We may suspend or terminate access for violation of these Terms. On termination, provisions that by their nature survive (ownership, disclaimers, liability limits) survive.

12. Changes to these Terms

We may update these Terms. Material changes will be announced in the product or by email before they take effect. Continuing to use the Service after changes take effect means you accept them.
